Dimov & Tashev Law Firm successfully defended the international brand in home textile and interior design English Home in a trademark opposition case against the Bulgarian Patent Office (BPO).
The law firm represented English Home in an opposition procedure implemented before the Bulgarian Patent Office in 2013, whereby the Office was requested to reject an unfair application for registration of "English Home" trademark in Bulgaria filed by a Bulgarian individual (natural person). Following a denial by the BPO to sustain the opposition the law firm initiated a case before Administrative Court - Sofia City, whereas the court overruled BPO's decision and sustained the appeal of English Home.
The decision of the Administrative Court - Sofia City was appealed by the BPO and following a court case initiated before the Supreme Administrative Court, a final and non-appealable decision dated 28.11.2017 was issued sustaining the decision of the first instance court and, respectively - ultimately recognizing the opposition of English Home.
